Service Provider
These Terms of Service ("Terms", "Agreement") constitute a legally binding contract between you ("User", "Member", "you") and Malik Systems Ltd, a private limited company incorporated and registered in England and Wales (Company Registration No. 17265815), registered in England and Wales ("Malik Systems", "Company", "we", "us", "our").
Trading Name
Malik Systems Ltd operates the online platform and subscription service under the registered trading name Qaboolify at qaboolify.com (the "Platform", "Service"). All references to "Qaboolify" in this Agreement refer to the Service provided by Malik Systems Ltd.
Nature of Service — Matrimonial SaaS Platform with Chaperoned Features
Qaboolify is a cloud-based Software-as-a-Service (SaaS) matrimonial introduction platform. It provides registered Members with access to a private, moderated database of verified Muslim individuals who are explicitly and exclusively seeking marriage (Nikah) under Islamic principles. The Platform incorporates a mandatory Wali/Guardian chaperoning framework, which enables a designated family member or Islamic scholar to supervise and participate in a Member's introduction process. This structural feature categorises Qaboolify as a supervised, chaperoned matrimonial service — not a mainstream social network, casual introduction service, or dating platform of any kind. Qaboolify operates a strict zero-tolerance policy towards casual, recreational, or non-matrimonial use of the Platform.
Acceptance
By creating an account, making a payment, or using the Platform in any capacity, you confirm that you have read, understood, and expressly agree to be legally bound by these Terms. If you do not agree, you must immediately cease all use of the Service.
Clause 1 — Member Eligibility
The Platform is open exclusively to individuals who satisfy all of the following criteria at the time of registration and throughout their membership: (a) aged 18 years or over; (b) a practising Muslim seeking lawful Islamic marriage (Nikah); (c) legally entitled to enter into a binding contract under the law of their country of residence; and (d) not previously suspended or permanently banned from any service operated by Malik Systems Ltd.
By completing registration, each Member expressly confirms their eligibility under the criteria above. Malik Systems Ltd reserves the right to require evidence of eligibility at any time and to terminate accounts found to be ineligible without notice or refund.
The Platform operates a zero-tolerance policy against registrations made for casual, recreational, fraudulent, or non-matrimonial purposes. Any account found to be in violation of this policy will be permanently terminated and, where appropriate, reported to the relevant authorities.
Clause 2 — Account Obligations
Each Member is permitted to hold one active account only. Duplicate, proxy, or fictitious accounts are strictly prohibited.
Members are solely responsible for maintaining the confidentiality and security of their login credentials and must not permit any third party to access their account.
Members must ensure that all information provided on their profile — including name, photographs, age, location, and stated intentions — is accurate, current, and not misleading. The submission of false, exaggerated, or fabricated profile information constitutes a material breach of these Terms.
Members must promptly notify Malik Systems Ltd at support@qaboolify.com upon becoming aware of any unauthorised access to their account or any suspected breach of security.
Clause 3 — Wali / Guardian Chaperoning Framework
Qaboolify incorporates a proprietary Wali (Islamic guardian) chaperoning system. This feature enables a Member to designate a trusted family member, parent, or Islamic scholar as an authorised guardian on the Platform.
The designated Wali receives their own secure, separate login to a dedicated Guardian Dashboard. Guardian Mode is available exclusively to Premium Members. The scope of the Wali's access is determined by the Member and may be configured across four permission levels: (i) Notify Only — the Wali receives notifications of key milestones; (ii) Read Only — the Wali may view conversations; (iii) Approval Required — the Wali must approve introductions before they proceed; and (iv) Full Participant — the Wali may actively participate in conversations. The Wali does not require a paid subscription to accept an invitation.
This supervised framework is a core structural feature of the Platform and constitutes a meaningful differentiator from casual introduction services. It is designed to uphold Islamic principles of modesty and family involvement throughout the marriage-seeking process.
Members bear responsibility for the conduct of their designated Wali whilst using the Platform.
Clause 4 — Acceptable Use
The Platform may only be used for the sole purpose of seeking a spouse for lawful Islamic marriage. Any other use is a material breach of these Terms.
Members must not: (a) send unsolicited, harassing, threatening, or sexually explicit communications to any other Member; (b) impersonate any person or submit photographs depicting any individual other than themselves; (c) misrepresent their identity, marital status, religious practice, or matrimonial intentions; (d) use the Platform for commercial solicitation, advertising, spam, or any unlawful purpose; (e) attempt to extract private contact information from other Members outside of the Platform's authorised communication tools; or (f) engage in any conduct that Malik Systems Ltd reasonably considers to be dishonest, harmful, or contrary to the spirit of the Service.
Violations of this Clause will result in immediate permanent account termination and, where Malik Systems Ltd considers it appropriate, referral to law enforcement authorities.
Clause 5 — Subscription Services and Billing
Malik Systems Ltd offers access to enhanced Platform features via paid subscription tiers ("Pro" and "Premium"), available on a monthly or annual billing basis (each a "Subscription").
Subscriptions commence immediately upon receipt of successful payment confirmation and will automatically renew at the end of each billing cycle at the then-current subscription rate, unless cancelled by the Member prior to the renewal date in accordance with Clause 6.
All subscription fees are charged in Pound Sterling (GBP) and are inclusive of all applicable taxes. Malik Systems Ltd reserves the right to amend subscription pricing with not less than 30 days' advance written notice to existing subscribers.
Subscription payments are processed exclusively by Malik Systems Ltd's certified payment service provider. Malik Systems Ltd does not store, process, or transmit payment card data at any point. All card data is handled in full accordance with applicable PCI-DSS standards by the payment provider.
Clause 6 — Cancellation of Subscriptions
Members may cancel their Subscription at any time without penalty. Cancellation is available through either of the following two routes:
(a) Self-Service In-Dashboard Cancellation (Two Clicks): Navigate to Settings → Subscription → Cancel Subscription. Confirmation of cancellation is provided immediately on-screen upon completion.
(b) Email Cancellation: Submit a written cancellation request to support@qaboolify.com. Malik Systems Ltd will confirm cancellation in writing within one (1) UK business day of receipt of a valid request.
Upon cancellation, the Subscription will not renew at the next billing date. The Member shall retain full access to their paid-tier features until the conclusion of the current, already-paid billing period, after which the account will revert to the free tier.
No partial-period refunds shall be issued in respect of subscription fees already charged and received, except where expressly required by applicable UK consumer law, including but not limited to the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
The statutory 14-day right of withdrawal under the Consumer Contracts Regulations 2013 applies to digital subscriptions. However, by expressly requesting and receiving immediate access to the Platform upon purchase, Members acknowledge that the right of withdrawal is waived upon commencement of the service, in accordance with Regulation 37(1)(b) of those Regulations.
Clause 7 — One-Time Feature Purchases
The Platform offers optional, non-recurring, one-time feature purchases including Profile Boost (24-hour enhanced visibility), Spotlight (48-hour featured placement), and the ID Verified Badge (permanent identity verification credential) (collectively, "Feature Purchases").
Feature Purchases are delivered instantly and automatically to the Member's account profile upon receipt of successful payment confirmation. The service is fulfilled in full at the point of delivery.
All Feature Purchases are strictly non-refundable once delivered and activated, as the service is consumed immediately upon delivery to the account. This policy applies regardless of whether the Feature Purchase was actually utilised by the Member following activation.
This non-refund position does not affect any statutory rights a Member may have under applicable UK consumer law in respect of defective or undelivered services.
Clause 8 — Content and Intellectual Property
Members retain ownership of all content they upload to the Platform. By uploading content, each Member grants Malik Systems Ltd a non-exclusive, royalty-free, worldwide licence to display, host, and transmit such content solely for the purposes of operating and delivering the Service to that Member and to other Members.
All profile photographs submitted must be modest, accurate, and comply with the Platform's community standards. Explicit, revealing, or unlawful content is prohibited and will be removed without notice.
All intellectual property rights in the Platform — including but not limited to software, algorithms, design, trademarks, and the "Qaboolify" brand — are and shall remain the exclusive property of Malik Systems Ltd.
Clause 9 — Account Suspension and Termination
Malik Systems Ltd reserves the absolute right to suspend, restrict, or permanently terminate any Member's account at any time, with or without prior notice, where Malik Systems Ltd reasonably determines that a violation of these Terms has occurred or is at risk of occurring.
Where an account is terminated due to a policy violation, any active Subscription will be cancelled at the end of the current billing period. No refund will be issued in respect of the remaining paid period, as the Member has received the benefit of the Service up to the point of termination.
In cases of serious violation — including but not limited to fraud, scam activity, exploitation, or criminal conduct — Malik Systems Ltd reserves the right to terminate the account and cancel the Subscription with immediate effect, with no entitlement to any remaining access or refund.
Members may voluntarily close their account at any time via Settings → Account → Delete Account. Upon deletion, the Member's personal data will be processed in accordance with the Malik Systems Ltd Privacy and GDPR Policy.
Clause 10 — Disclaimers
Malik Systems Ltd provides the Platform as a technology-enabled matrimonial introduction service. It does not warrant, guarantee, or represent that use of the Platform will result in any particular outcome, including but not limited to a successful introduction, relationship, or marriage.
Malik Systems Ltd is not responsible for the conduct, character, representations, or actions of any Member, whether on or off the Platform. Members are strongly advised to exercise independent caution and due diligence when engaging with any other Member, particularly when arranging to meet in person.
Compatibility indicators, profile rankings, and similar features are provided for informational purposes only and do not constitute professional advice of any nature.
Clause 11 — Limitation of Liability
To the maximum extent permitted by applicable law, Malik Systems Ltd's aggregate liability to any Member arising from or in connection with these Terms or the Service (whether in contract, tort, negligence, or otherwise) shall not exceed the total subscription fees paid by that Member during the three (3) calendar months immediately preceding the event giving rise to the claim.
Malik Systems Ltd shall not be liable for any indirect, consequential, special, exemplary, or incidental loss or damage arising from or in connection with the use of the Platform, including but not limited to loss of data, loss of profits, or loss of opportunity.
Nothing in these Terms shall exclude or limit Malik Systems Ltd's liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot lawfully be excluded or limited under applicable English law.
Clause 12 — Amendments
Malik Systems Ltd reserves the right to amend these Terms at any time. Where amendments are material, Malik Systems Ltd will provide not less than 14 days' advance notice to Members via email to their registered address.
Continued use of the Platform following the effective date of any revised Terms constitutes the Member's acceptance of those revisions.
Members who do not accept revised Terms must cancel their Subscription and cease all use of the Platform prior to the effective date of the revised Terms.
Clause 13 — Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of England and Wales.
Any dispute, claim, or controversy arising from or in connection with these Terms or the use of the Platform shall be subject to the exclusive jurisdiction of the courts of England and Wales.
In the event of any dispute, Members are encouraged to contact Malik Systems Ltd at support@qaboolify.com in the first instance to seek an informal resolution. Malik Systems Ltd will respond to formal complaints within five (5) UK business days.
